ANOTHER Story of School Children exposed ROUND UP and GM Corn

Sprayed by the University of Berkeley back by Novartis

I am the chair of a parent group that formed to protect our children from spraying being done by the University of California, Berkeley. On the Gill Tract, a 15 acre site used by the College of Natural Resources for GE corn research. We have asked them to stop using Round Up on the field next to our elementary school of over 430 children plus staff. They have refused to stop and on Feb. 14th they sprayed Round Up on a section of the field directly across the street from our school's yard where the children were hanging out during their recesses at the fence and on climbing structures. 

The University is outside of the jurisdiction of both Albany Unified School District and the Cities of Berkeley and Albany within which it resides. The College of Natural resources board of directors is composed of representatives of Novartis ( they may compose 50% of the board!) NOvartis gives UC lots of money, but they claim their corn research is not dependent of Round Up. We are very concerned that are children are exposed to Round Up over and Over again. They will do a larger spraying again at the end of March.

We are searching for other strategies to get them to stop. If anyone has suggestions we would greatly appreciate hearing from you.

They have refused to stop and on Feb. 14th they sprayed Round Up on a section of the field directly across the street from our school's yard where the children were hanging out during their recesses at the fence and on climbing structures. We need some legal advice because the University did not give us 24 hours notice of this spraying.

We would like to know if there is any thing we can do legally to either sue them for breach of contract (we believe they made an agreement with our school district for either 48 or 24 hours notice), or to somehow pressure them with other legal means.  One parent suggested small claims court for breach of contract. Do you have any suggestions for us? As you know, the University is outside of the jurisdiction of both Albany Unified School District and the Cities of Berkeley and Albany within which it resides.
